Terms of Service

1. Acceptance

By accessing aeoutdoorliving.com, aedesigntool.com, or using AE Outdoor Living's AI design studio (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. The Service

The Service generates AI concept renders of outdoor living projects from photos you upload. Renders are conceptual visualizations, not engineered construction documents. They are not to scale, are not site surveys, and do not reflect setbacks, easements, utilities, soil conditions, HOA rules, or applicable building codes. Final built work will differ, sometimes significantly, and requires a signed construction contract and engineered plans produced by AE Outdoor Living.

3. No warranty on renders

Renders are provided "as is" for design discussion only. We make no warranty, express or implied, that any element shown can be built, is code-compliant, or will fit your specific yard. No quote, price, or contract is created by generating or downloading a render.

4. Your photos

You represent that you own or have permission to upload the photos you submit. You grant AE Outdoor Living a limited, revocable license to store, process, and transform those photos solely to deliver the Service to you and follow up on your inquiry. See our Privacy Policy for details.

Do not upload photos that contain other people without their consent, that depict minors, that show recognizable license plates or street addresses you would not want stored, or that you do not have the right to share.

5. Acceptable use

• No reverse engineering, scraping, or automated abuse of the Service.
• No uploading of unlawful, infringing, hateful, sexual, or violent content.
• No use of the Service to deceive a third party (e.g., to misrepresent a finished property in a real-estate listing).
• Watermarks on downloaded renders may not be removed or obscured.

6. SMS & call consent

When you check the consent box and submit the lead form, you authorize AE Outdoor Living to contact you by phone and SMS at the number you provided, including via automated technology. Consent is not a condition of purchase. Reply STOP to opt out. See the Privacy Policy for full TCPA disclosures.

7. Intellectual property

The AE Outdoor Living name, logo, and site design are our property. AI-generated renders created from your photo are licensed to you for personal, non-commercial use related to your project. We retain the right to use anonymized, non-identifying renders in our portfolio and marketing.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AE OUTDOOR LIVING AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED BY LAW.

10. Indemnity

You agree to indemnify and hold harmless AE Outdoor Living from any claim arising out of your misuse of the Service or breach of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflicts of law rules. Exclusive venue for any dispute lies in the state or federal courts located in Maricopa County, Arizona.

12. Changes

We may update these Terms from time to time. Continued use of the Service after a change constitutes acceptance of the revised Terms.
